Anyone come across this scenario... OldSchool: Ok, a really good friend at work just told me today he's having marital problems. They've been married for 11 1/2 months. Is there a law concerning division of property if the couple has been married less than or more than a year? They don't have children and everything in the house is his and he purchased the house before they were married.

I'm sure if it does exist, then it's a state issue but just wondered if anyone has experienced this. I'm trying to get him to seek counsel, but in the meantime I thought I'd ask here.

Re:Anyone come across this scenario... turning leaf: Whether 2 days or 4, whatever you bought together after the wedding is community property. The house, since it was purchased before the wedding, should stay his, UNLESS he put her name on it after the fact. gets?

Thanks for the reply. I'm actually kitty-corner from him at work and feel badly for him cause he's been trying to keep his cool in the meantime. I'm in Illinois, btw and am not sure if her name is on the title or not.

Re:Anyone come across this scenario... turning leaf: They don't have children nor property: that's awesome! he may not need to retain an attorney.

Here's my advice: tell him to go to your county website and look for family law: dissolution of marriage. if your company has an employee assistance program, tell him to call HR, they may refer him to attornies he can go to for initial consultation and not pay.

Thank you for the quick response again. I've been calling my uncle who represented me, to see if he could give some free consultation. Our company does have a solid EAP program, which I used for counselling. I will pass that along to him.
