I'm pretty sure the amount of time had nothing to do with it.
There is the possibility he could have an annullment, if he can get a judge to go for it. Much easier than a divorce- basically says the marriage is invalid. I was only married for 3 months, but the judge wouldn't annull because the "marriage had been consummated." (I was pregnant, it was kinda hard to hide.)
Annullment laws are probably different from state to state too. Worth checking on though!
Re:Anyone come across this scenario... jen: In CA, they have a summary dissolution for marriages of less that 5 years, with limits on community property assets/debts. It is a quicker dissolution process with less paperwork requirements...
If it was his before the marriage - it should be his separate property if the marriage ends
