Bankruptcy + Divorce Pal0ma: ??? was wondering if anyone here has filed for bankruptcy just before, during or after divorce? With the debt me and my husband have, my attorney has suggested that I file bankruptcy, so that I can afford to keep the house, the car, and not have to sacrifice much for me and my son? Any one else do this or know anything about it??
Re:Bankruptcy + Divorce matt: Depending on your debt situation, it might be a good idea. You will be able to clear off the unsecured debts and keep your house and car. Its always a tough decision, but i think your lawyer is giving you good advice. I have seen couples file BY, before, during, and even after the divorce. Unfortunatly, Divorce and Bankruptcy many times go hand in hand. But, i think you will find much emotional relief once it is over. Write me with more specifics. Take care
Re:Bankruptcy + Divorce sourpuss: sometimes it is the best course of action. sometimes it is just a bandaid.
in addition to a lawyer, see a financial consultant who can explain the ramifications of filing bankruptcy.
much like divorce, the fallout lasts for years and may interfere with you ability to get credt, loans, mortages & occasionally even jobs.
Re:Bankruptcy + Divorce in_search_of: However, if you are considering this, I would speak to your lawyer now, because Bruptcy laws just changed, and therefore, depending on your debt and income, you will not be able to file chapter 7 soon, more than likely. And then you will both be paying into the bankruptcy plan for years.
