Teachers...What is the legal justification for Federal Govt to be in Education Lome: Hey guys....
I am in a debate ....
So what is the legal reason that the government got into education ?
I have used Title One, Seperate but Equal, and National Defense after Sputnic (science and math)...but, I can not find the articles or actual pl for federal involvement....
I have looked at the state constitution...and wonder why the U.S. Constitution has not been ratified to hold power to regulate each state in this issue....
any help.
Re: Teachers...What is the legal justification for Federal Govt to be in Education sourpuss: i could be completely off base here, but someone once told me the roots of american public schools (as we know them today) grew out of the american revolution, when there were 13 (?) states suddenly joined together without anything to tie them together.
everyone had come from various parts of europe & the world, and some bright light in the new gov't figured standardized education was a way to recify that.
i don't know if that's true, but it would explain why it's federal & not by state. they didn't want the states getting all divided up against each other.
Re: Teachers...What is the legal justification for Federal Govt to be in Educati pluscachange: There is no Constitutional basis for such a thing. All powers not specifically delegated to the fed are reserved to the states, or the people, respectively.
And if you're thinking about that concept, consider how much of the Fed really is un Constitutional these days. It makes my head spin that they get by with this much and nobody really even knows to question.
Enough politics for me today though, this is a divorce/seperation site. :)

Sourpuss, You are correct. when I was school, I remember something coming from the Federalist Papers? concerning this...but, I can't find it.

Yes, we have been discussing the Supreme Court and how it is not using the Constitution as its only instrument in its interpretations .
Question that I posed....If there is not a Federal Minimum Standard, then how can all be granted an uniform education? This does fall under Fape....but that was not created until the 70's....so, my thoughts are ...such as In No Child left behind...the only real power that the Feds hold here is the ability to withhold taxes....

Re: Teachers...What is the legal justification for Federal Govt to be in Educati in_search_of: Well, I am not a teacher, and I am certainly not a constitutional scholar, but my guess as to the basis of power, when not talking about the areas of religion discrimination and etc. Would be the penumbral powers that comes with the general health safety and welfare clauses of the constitution.
