Re: urgent help in_search_of: Don't be so quick to jump about the fact that she has no legal recourse, there is a possibility that the court in its inherent powers can divide the property just like in a divorce....it depends on state laws...in KS the courts will do that...so you would have some legal recourse...

Re: urgent help in_search_of: And in my state if you own it during the time you are married it marital property, whether you had it before you were married or acquired it during the marriage, makes it so much easier to divide things up!
Re: urgent help sourpuss: and in some places, it doesn't matter who "owns" it, the court will not throw a spouse & children onto the street.

my aunt (a stay at home mom) was allowed to stay in a house owned by her hubby until the children were grown or she re-married.  he paid the mortgage, she paid the bills.
Re: urgent help in_search_of: exactly...however, that moves away from the real issue here, that they are not married, so it may or may not matter what the divorce statutes say, because the court is pretty wide open to make decisions based on their equitable power when there is not a marriage involved.
