Court Monday-Are Judges Sympathetic? leem03: :-[
So I got a letter from my attorney. December 1st is our court date. The date my marriage is to be officially over. BUT, I don't know what's going to happen. She still hasn't received anything from my stbx's attorney regarding property division, custody or anything. As I stated before we decided to try & do things ourselves and not go through a mediator. I personally don't think I would be able to sit at a table with strangers and discuss MY HOME, MY STUFF, MY CHILD and have them help in any way decide what I should get & what he should get. So now nothing is done.
My attorney tells me court will now go in a couple of ways. Either the Judge will be totally ticked off that nothing is done because he'll feel like we're wasting his time & the court's time so he'll mandate us go through Arbitration. Or my stbx will have to say we don't know if this is what we want & tell him we want to seek counseling for a month or two to see for sure.
OR........I don't know. What do you guys think? I mean this guy has to see thousands of people. Doesn't he know how emotional this is? Will he be sympathetic? Now I'm scared that we'll have to go through arbitration & really have someone basically decide for us who gets what. I'm terribly frightened that my marriage & my family has come to this.
My attorney said she spoke with my stbx's attorney and he still couldn't get him into the office to complete any paperwork. Maybe he'll do it today or something, I don't know. We've had 6 months to do something & we keep putting it off. I'm doing nothing because I'm still holding out a glimmer of hope that this won't happen. I love this man! I am pathetic I know. He has serious problems & I ENABLE him to continue. Yes I am your typical enabler. Look it up....it describes me!
Anyways....do any of you have any thoughts on what the judge might do? Have your judges seemed sympathetic that 2 lives that once had so much hope & love together are now no more?
Oh gosh....I am aching inside so badly & the idea of what could happen is driving me more insane!!!!
OH YEAH & Happy Thanksgiving to all of you. I'm sure this holiday will be hard for many of us.
Re:Court Monday-Are Judges Sympathetic? galil: Judges ar far from sympathetic. You are just a number to them and all they want is to move the case along and get you out of there court room.
In the end the one that does the most fighting is the one that gets the worst deal. I think judges just want to have an easy job and move cases along. If you fight for everything you deserve ,trust me, You will be punished by the jusge accordingly.
