confused... sooverhim: my stbx just emailed me telling me that he had a meeting with his lawyer and he needs my address so the sheriff can serve me divorce papers (we have a year seperation period before papers can be served) anyway he said the lawyer has to get my parents address to serve the papers there--why?? i don't live there anymore, it was the city that we married in but i haven't lived there in years!
second, when we seperated his responsibility was taking care of the divorce, seperation, everything legal like that and i checked in with him numerous time and have still been doing so...it's been 8 months since we have lived seperately and now he is telling me that when the divorce goes to court (which i don't have to go) that we need a witness showing that i moved out of the house in december...all this because we didn't file for legal seperation--his responsibility and i have asked him so many times about the lawyer and their meetings and everything...now he's saying we wouldn't need a witness if we had filed for seperation...why did he not do that in the first place, now i'm beginning to think he just got an atty and i'm really upset about this.
i do not want my parents to have to get the papers...that is not right...i'm so confused as to what is goin on and why all thsi happens, and everything. i do not want to go to court with him, i do not want to see him...i do't think i have to...ugh what am i going to do........................
Re: confused... tyrogers: Where are you at? Usually you have to be served where you live. How about calling him and seeing if you can stop by the attorney's office and pick them up?
BBH
Re: confused... ColoHill: I agree with BBH. Usually papers have to be served where you live. However, I do know of cases where they tried numerous times and couldn't get the person and took them to a secondary address. Anyhow. Good luck. I can't answer any of those other questions or I would. Sorry!
Re: confused... sooverhim: thanks for your replies...i live in sc...my parents are out of state...we got married where they live. i know they haven't tried to serve them at all because it's not even time. i just don't want my parents to have a sheriff coming to their house in a car and in uniform...just not fair to them, they had enough problems with us splitting (upset about it that it didn't work out, i don't want to throw it in their face) i thought he was supposed to bring them to me and if he couldn't find me then i would be served them by a sheriff...ugh
Re: confused... tyrogers: They can serve them certified mail too.
