Pension/Child support, etc - HELP! LettinGo: The short story:

STBX was terminated from his employment over a month ago and I have not rec'd any support since (although he IS already working FT somewhere else, just for less money).

He is cashing out his pension and is supposed to pay me the child support owed from this.  I honestly have no interest in taking his pension other than the support I am due.

In order for them to release the pension on his "terms", I have to sign a spousal consent WAIVING my right to his pension.  This is the way HE elected the payment to be done.  Basically, that means I have to put my trust in him that he will pay me when the check comes.  He is a pathological liar, btw.

If I refuse to sign, nobody gets anything and it delays things.

My house (mortgage) is depending on this.  I don't have the money for a lawyer right now ... no clue what to do.  I never fight with STBX because I am sick of conflict, but I am tired of being taken advantage of.

Re: Pension/Child support, etc - HELP! sourpuss: don't sign away your rights.  you will get nothing from him.

if you sign the waiver, you will get nothing, and you willl give up your right to get it.

if you don't sign the waiver, you will get nothing right away, but you will eventually.

I told him I was refusing, at which point we had a conference call with the investment company because with STBX on the line, they can release details.  Here is what can be done:

- I can sign and he will get a lump sum check, or
- I can refuse to sign, and he will get monthly payments for the rest of his life of $33/ month (lol).  IF he should pass away, I will get $16/month.  It is not a huge pension because he only worked there a few years, but it was enough to give me the CHILD SUPPORT he owes me.

So, basically NEITHER benefits me.  He agreed to sign a document in front of a notary stating he would give me July - Sept child support out of the money, and if so, I will sign.

Who knows what will happen ... sigh

Maybe my next support court date will come BEFORE the check is cut and they can take it or something ...

Re: Pension/Child support, etc - HELP! in_search_of: I am just shooting in the dark, but can you ask the company to write the check payable to you and him, that way the bank cannot cash it without both signatures, and you can just go to the bank with him and get your cash?
