Should I leave the house? BarbJo: The past few months have been my husband staying at his brothers house.  When it's his weekend to have the kids I have to leave and stay somewhere else.  I told him that this has to end.  Either he gets a new place so he can take the kids on his weekends.  Or he can come stay at the house in the spaire bedroom.  I will not leave my house anymore.  The other option is that he stays at our home and I get a new place.  He can then sell the house and we split the cost.  I don't know what the best option is.  I haven't disscused this with my attorney.  I was told by him that I should have to leave the house on his weekends with the kids.  I don't want to make a mistake by leaving the house if this does go to court.
Has anyone had experiance with this?

        I can't see how this should effect your court case as he is the one who left intially and you spend most of the time in the house. Talk to your lawyer just the same. Seems a small price to pay as opposed to the two of you having to sell the house. Why can't he take them to his brothers'?


Re: Should I leave the house? BarbJo: There is no place for them to sleep.  His brothers house is a bachlor pad.  My kids are 2 and 3.  If his brother sets a room up for them to sleep.  That's fine.

      If there aren't any legal ramifications then I'd just try to look at it as a sacrifice that you make for the kids sake. This way they're not in unfamiliar surroundings and they get to spend some time with their father.
Re: Should I leave the house? sigkapgirl: Don't leave the house. If the divorce is his choice (and I think, from reading your past posts, it is) then he can find a new house or apartment so that he can have the kids on the weekend.

I think you are right when you say that you are not leaving the house on the weekends anymore. Don't let him control this situation.

Its his choice. Let him deal with the complications.
