If she is taking her share of the money out then you shouldn't be responsible for any fees or penalties that the plan may wany to charge you. You might want to talk to your lawyer about that one.
Re: She officially got my 401k today Ian: I went by the broker today and signed the paperwork to give her half of my - sorry "our" 401k. Funny thing is I wanted her to have it, I don't give a dam#. I took out some for me too and I am going to go on a trip alone and reflect on life. You only live once. It made me feel A LOT better - finally do something just for me.

He makes 3 x's as much as I do and kept just about everything. Including the house that will be decided upon when we go back to court. FYI-it was a mutual split, more his idea. But for some reason he thinks I should't be entitled to anything. *grumbles*
Anyhow, I am sorry she "got" your 401K, that's not cool. But enjoy your trip.
