After several days of looking...I am finally telling my story sunnydays: I have been seperated from my stbx for 1 month. He swears he was not cheating, but has already moved in with a new woman. I did not want this divorce, but it is happening. Every chance that he gets, he brings me down. Today was a great day, and he called. He knew I was in a good mood, so he wanted to be sure I was not going to have a good evening. He started spewing nasty things at me, and insisted that he have our daughter for more days than we agreed to. I am so angry at him. He keeps agreeing to things, then he talks to his gf (who is 7 years older than him) and calls me back saying he is sick of me being in control. We are trying mediation, because he does not have the resources to go through court, but I don't think it is going to work. What are my rights prior to the divorce, as far as custody goes. Do I have to let him have her whenever he snaps his fingers. I need some support!

I know for me (Oregon), unless there is a parenting plan or court order on the books, he is the father and has just as much right to see your daughter. I had to stipulate in my legal separation paperwork that I was taking the kids and had to put what address we would be living at. Then my h had to sign off.

I don't know your rights, because I live in Canada...but my lawyer here told me I didn't HAVE to send the kids to their dad UNTIL we have a court document.... Otherwise, possession is 9/10s of the law...
I'm not that mean, and have practically BEGGED him to take them...to see them...I did it once and won't do it again... He can contact me to see them!
As for the g/f...my STBXH said the same thing...denies it...(yet, slipped out, it didn't start until after...)
So, I can relate to you there too... The thought of another woman holding my babies, and "mothering" them soo soon, hurts...and I am NOT ready for it...
I didn't want mine to end either... chin up girl..we can do it...
