Need help on divorce questions shockedandamazed: My husband and I had signed a Separation Agreement and we filed as co-petitioners. He signed away more than half of his half to me.....and now he has disappeared. If we both sign the waiver of hearing form, then we will not have to go to court, but since he is not here - should I go ahead and set up the hearing??

Also, what if the judge looks over this Sep. Agreement and decides to give him half of everything? (I have more to lose than he does) .

Lastly, my husband, put our address (where I am living at currently) on all of the paperwork..so if I schedule the court hearing...how will he know about it?

One more thing....he hasn't even sent in his Financial Affidavit either....can't he get in trouble with that??

Re: Need help on divorce questions toofast: Yes, you need a lawyer.  (I am a lawyer and I hired a lawyer.)  It will make everything much easier... you need someone to tell you what is going to happen before it happens, to ease the stress and guide you through the process.  You have done what usually takes the most time-- the settlement/separation agreement, so I wouldn't think it would be too expensive to hire someone to take you through the nuts and bolts of the hearing and paperwork.
