Bankruptcy...anyone do it?? superwife: I don't know if I want to go ther. My situation feels hopeless right now. His is probably worse, which is why mine is so bad. I'm carrying all the debt right now- b/c no one has put a gun to his head. I am aware that nobody will either, b/c I don't beleive even the courts can scare him into paying his debt. I just don't know if I want to go there.

I have never filed bankruptcy but I work in the debt and bankruptcy field so I am very familer with this situation. First of all before you can even file you will need to attend credit counseling due to the new bankruptcy laws. Also not sure if you are employed but if so you need to meet a minimum income requirment for your state to be able to file chapter 7 otherwise you only qualify for chapter 13.
Check into credit counseling (you would have to anyway) they can help more then people even realize (make sure they are not for profit!). I deal with divorce decrees all the time and the thing is even if the courts did tell him that he is responsible for such and such debt no creditor honors divorce decrees so they can be somewhat useless if he chooses no to pay.
Good luck I know this sucks and I deal with people in your situation all the time. Do everthing you can to avoid it because you are right you dont want to have to go there.

As far as the income, do you mean if I make too much, they wouldn't consider me? If that's the case, i'm sure I make too much :(

[/quote"> That's what I assumed, which was the reason I thought of this option. I do not want to get stck with this alone, which is likely going to happen. I hate to go there, but I feel like I can't just sit here and single-handedly clean up our credit without some sort of fight. Of course if I have to, I have to. I need to get on the right track.

However make sure it is "written" word for word in your divorce decree what he is responsible for and what you are responsible for...

Was it worth it? yes it was.
Runied my Credit. But got Clear of that Debt.
In Texas you can keep car , house etc *IF* don't owe on them.
Now 7 years later , in middle of Divorce.
Hope Divorce Final middle of Jan. Then look for New Wife someone Nice and Lovie :)
