Re: getting technical dragonfly: Oh I definitly think there is "emotional or mental" cheating even before the physical happens. My X was cheating on me emotionally with the OW by phone, text message, etc...for a few weeks before he actually slept with her. Although, he didn't spill the beans and ask for a seperation for about a month into their affair.
Intimacy is more than sex...and being intimate with someone other than your spouse is cheating...plain and simple.

Exactly! If they take something they pledged to you and give it to someone else..that's cheating. You might even argue that since the vows don't mention sex, but do mention "love, honor, cherish, etc" that emotional cheating is a greater violation of marriage than physical cheating is.

If married, I'd say yes.
If not married, I'd say no.
