Re: Is he really that stupid?? threetimeloser: That will actually work once. The judge might give him one chance to get a lawyer and after that he won't have any excuse.
Re: Is he really that stupid?? superwife: Mine actually has a lawyer (well, he did for the first court date for custody a month before). I can only imagine was his lawyer may have thought when he found out that my ex didn't show up at court. He could have even postponed as soon as he got the summons, claiming he wasn't ready. We served him on the last possible day (at my lawyers advice). The judge thought that was kind of wrong (wasn't my idea), so they def. would have granted a postponement. but now, in addition to the postponement (2 months from the original date), he has been ordered to pay the 17%. Oh well, at least i'll be able to feed my child in the meantime ( and get my cable turned back on).
Re: Is he really that stupid?? threetimeloser: Your lawyer gave you bad advice, Imagine that?! I hate lawyers, and I almost became one. Came to my senses in time but I know a thing or two. Be careful or I will see expensive charges. The delay means one extra day in which he gets to charge you. Had he sent the papers in time to your ex that a large portion of the divorce handled by now. Read up a bit so that you do not call him to ask questions you can find for yourself. got to divorcenet.com or nolo.com. Also, don't let the lawyer fill your hed that you can get some outrageous claims. Play fair and it will be less expensive for you.
And the order to pay is also standard. The courts weren't going to let your ex just go without making sure support payments.
The hardest thing to understand is that your case is no more special than anyone elses. Divorce is a game with rules and they are usually a straight line unless you order a jury trial and that is a whole different ballgame.
Good luck.

Yep, your just another file... ::) My lawyer is pathetic and it is a good thing I investigate and talk to other lawyers on ways to push my lawyer. (legal aid)... ::) Otherwise, my lawyer isn't about to tell me... Like, "what I don't know, he won't do..." ???
I found out that I have a right to know where my children will be going, and to even see the house. To make sure it is safe, etc. (when/if it ever happens) ;)
I found out that my STBXH doesn't get over nighters with my babies, not until they are older...etc. ;) If he was always part of their lives since day one, then it would be considered... but for now, supervised visits is what he has... ;)
I just HATE phoning daily, and I have been considering getting another lawyer, BUT, then I will be back to square one! >:(
My lawyer after 5 months STILL hasn't served my STBXH with the Petition for Divorce... SOOO, when he does my X has 20 days to respond... >:(
Very frustrating, but soon, my time will come... :) and my STBXH fanasty world will come crashing down ;D ... And my children and I will be okay...financially.
Re: Is he really that stupid?? threetimeloser: That's exactly what I mean. Your lawyer hasn't served your ex and you are calling him to find out what is going on. Meanwhile he continues to rack up the charges. Maybe I should have been a lawyer. I would have made a killing being honest. Then again who would believe. Catch 22.
Someone else posted that they don't know where there ex lives. Lawyers should be more forthcomming and keep people from being misguided.
And in my perfect world, my beautiful spouse stands by me in support as I get sworn in to the presidency. Yeah ;D
