I was able to file Head of Household since I had a legal separation in 2003 even though my divorce was not final until March 2004. This was great for me because I got to claim EIC which gave me $$$ back. Course he tried to get 1/2 of it but he lost that in court!
Might want to check and see if you qualify for that.
