Re: Should I do court or a divorce agreement Lumpy:   Don't sign that agreement! Whether he likes it or not, he's probably on the hook for half the daycare. If you have to go back to work, it's only fair. Unless of course he's willing to take the kids while you're working. This si pretty standard and is tied to the custody agreement. The only way he can avoid paying daycare is if you sign off on it. Same deal with healthcare. If you are providing coverage his child support is going to be a little higher. Conversely, if he provides healthcare it will reduce his support payments. It sounds like he's in for some rude shocks. Most of child support is non-negotiable. It's determined by a formula the court uses to determine what is fair.
Re: Should I do court or a divorce agreement audi_driver: three things i would do.........

1. get a lawyer......if you have no income, get a court appointed one.....there realy is no difference in an attorney if you aren't fighting over children.

2. get the agreement and tell him you need to think it over.....then bring it to the lawyer..........

3. the best way to get what you want financially is to tell his lawyer you are going to reuest a discovery on his income.......Tell him you can do it through the IRS but he doesn't claim all the money he makes.......that might scare them a little.
