  That is a great idea. Whether or not you decide to collect it, you should file for it. If she doesn't pay it that's more ammunition for you if she tries to change custody. The only problem with corkscrews' argument that I can see is that it doesn't sound like your ex has much to give. You'd probably just be taking something out of the kids' mouths while they were with her ya know.

good point lumpy, but i don't think this would be the case.  she might CLAIM this, but she does make very good money considering.  she works at a very *upscale* restuarant and the state only taxes her on (i believe) 9% of her sales, which makes more than half of what she makes *under the table* so to speak. 


Re: Ethics of Child Support Lumpy:   That changes things then. When you mentioned $150 a month, I kinda cringed. I'm not sure about the laws of your state, but here in Cali they can compute her average "tip" income by looking at what she's paying in taxes.
Re: Ethics of Child Support freovir: right.  they do the same thing here in michigan, but she only pays taxes on 9% of her sales. . . most people tip 15-20% and it is probably higher where she works.  most of her income does not exist according to the IRS.


Re: Ethics of Child Support dontgetit: I am going to jump in here and give my 2 cents - my ex left 7 months ago for another amn who earns in excess of 200k per year....She earns approximately 30k per year.
when she left it was by herself, our 10 year old daughter refused to go and after a short custody battle she relented and signed off on my daughter's staying in what was the family home.....
Now since she left she has not paid one single dime nor have I asked for one - she spends her entire pay cheques on clothes, makeup etc....Does that piss me off, yes - do I want her money no, do I need her money no....If I go after it the best that can happen is I can piss her off and get limited satisfaction - you have said that it is a point in principle....My attitude is screw the principle, leaving us alone is payment enough.....
