What about the money
.

What about the money moksha: What do you do when the papers haven't been filed yet and he is just spending everything we had?  I got the Amex bill for last month and he spent over 4000 dollars on playing with his new girl.  Braves games, hotels, bars, restaurants, new clothes etc etc.  He tells me that we don't have enough money for this or that and then he goes and blows our credit on his fancy "new life."  What can you do about this? Have some of you had this happen?  Is there any recourse we can take?  He feels justified since I am a stay-at-home mom and he's a realtor.  He always treated me like it was HIS money.  I guess I can just sit back and wait until the child support, alimony etc kicks in if I get it, but it just sucks when my big night out is a trip to Wal-Mart with the kids.
Re: What about the money fkunone: Don't file the papers and address how the debt is supposed to be settled.  In some states, it's considered property.  Call your lawyer.

Re: What about the money Lumpy:   Your finances should already be seperate at this point. No joint checking accounts, no shared credit cards, etc. If these debts are incurred after the finances are seperated then he should be solely responsible for them. If you haven't already done this, do it now.
Re: What about the money corkscrew: If you can get him to vouch for the date of separation, I don't think the judge will hold you accountable for his charges after the separation date.  Different states, different laws though.  Call your local law center and ask some questions.
Re: What about the money Maximus: I'm going through a similar financial situation.  I make around $8K a month as I work overseas as a contractor.  The STBX was blowing my money away since i started this job 2 years ago, and she is now the one who filed the paperwork.  Since she filed, she has still been spending our money on everything.  I have been advised not to take her off my account as it would look bad to the lawyers.  So, i just asked her to only spend $2000 a month (25% of my deposit for the child support).  It didnt work last month, so we'll see if it works this month - or I will be forced to take her off the account.  Is there anything I should be doing differently?  I just cant wait until its over as i'm white as a sheet from all the money she drained me of, which is appropriately now called "blood money".

Hang in there!
Max
