Unmarried with child, needs advice on leaving the state anorm03: I am currently living in the state of Florida. My boyfriend and I just had a baby 1 month ago. I want to leave the state and move back to Maryland to be close to my family. We fight constantly and I want to bring our baby up in a happy environment. Plus he is never home and acts as if he doesn't care about me or the baby. He is only around at night to sleep. Can I leave the state without getting charged with kidnapping? Will this hurt my chances of getting full custody? Will I have to return to Florida if this goes to court? We have no other family in Florida and all of my family and his family are in Maryland. Therefore, there is no way on God's green earth you can be charged with kidnapping. As for the state issue...Law is the child's legal state of residence is the state in which they have live the majority of the last 6 months of their life. You are in the same boat I was dear. If you feel this is a bad environment for you and your child and you have support with family home, by all means go! Since the baby is one month (let's say for arguement's sake exactly for this example) than you only need to live in Maryland 1 month and one day for Maryland to be the child's legal state of residence and the court system that any custody issues will stand in. My only question for you is does your boyfriend currently pay support or have any custody rights through the court directly, or is he currently merely a name on the birth certificate? If it's the latter, you are free and clear. If it is the first, I would still consult with a lawyer before making any moves. :)

He does not pay child support or we haven't been to court over this at all. I'm going to move back to Maryland. I just don't want to do anything that will look like I'm a bad mom. I want the best for my daughter and for her to be brought up in a happy and loving environment. Did you end up moving?
