In a lot of states, you have that right automatically unless you're only allowed supervised visitation. It's called the right to first refusal. If your ex can't watch your child on her time she's supposed to offer you the opportunity before finding anyone else.

I'd scratch the surprise visit and call your lawyer. She can't keep that info from you. Sounds like she needs to hear your lawyer tell her that.
