Personal Lives clause in Separation Agreement? falling: I was recently given a separation agreement from my “wife.” I live in Virginia, if it helps. I was told it was a typical separation agreement. I have many questions but I’ll start with this. My wife had the agreement written up and it has a “Personal Lives” clause. It states “Each party shall be free to act or to do as he or she sees fit and to conduct his or her personal or social life as fully and freely as if he or she were unmarried.”

Is this typical? Would she have to ask to insert that phrase or am I just paranoid?

I find it unbelievable and heart aching.

I guess she just wants to have extra-marital relations now and not worry about it coming out in court. You should see a lawyer if you haven't already. Your own.


Re:Personal Lives clause in Separation Agreement? ChrisJane: Double check just in case VA laws changed. My cousin was divorced in VA years ago. This was a typical clause. Its worded in my OH agreement in simular wording. This protects either of you from using what you do from the time those papers were filed through the divorce.

So if you catch her sleeping around with someone now, it can't be used against her.
