Re:Personal Lives clause in Separation Agreement? RecoveringinDE: My ex and I did our paperwork together online. When it was reviewed and ready to print it came out the same. That after the agreed upon separation date we cannot count against the other their actions. And as you see =) I'm in DE. I think that is a typical phrase.

Re:Personal Lives clause in Separation Agreement? poohbear1: I'm on my first week of separation from my wife and we have not done anything formally as far as paperwork partly based on my hope we can work things out. But it doens't look good right now. She's determined she wants out right now and I said we shouldn't have a relationship with anyone else while we go thru this separtion. Is that legal considering we're married? What about my kids? Are they going to me the new man in her life...can she do that? I'm in TN.

Re:Personal Lives clause in Separation Agreement? falling: hey pooh,

Sorry about your situation. I’m not a lawyer, but I do believe during the process of separation you are legally considered married. And as far as the kids, I believe she can do what ever with whomever while she has the kids. Sorry.

My situation has not changed. We still haven’t signed a separation agreement. Every time it comes back to me something new is added or discreetly taken away. I haven’t had an agreement written up in hope she will change her mind, but it seems she is becoming vindictive. I’m still hoping for the best.

It states “Each party shall be free to act or to do as he or she sees fit and to conduct his or her personal or social life as fully and freely as if he or she were unmarried.”

I don't know why I'm bumping this but I have the same thing in my MSA and I'm a California resident.  My legal beagles advised me to have this included in it.
Re: Personal Lives clause in Separation Agreement? jillieb44: I wish I had a clause like that in mine (no separation agreement, just filed for divorce) only because I had plenty of time while married to get over the ex and the way he was treating me and I'm ready to move on. If he knew what I was doing I'm sure he'd try to create a huge scene.
