Re:Personal Lives clause in Separation Agreement? falling: Unfortunately, my attorney told me the “personal lives” clause is standard in a separation agreement in Virginia.
I think it is incredible that two people can commit to each other in front of God, family, and friends and it all be null and void with the flick of a pen.
I hope you the best, I think there are a few others in here from VA. Maybe one day we can do a VA meet and greet. Until then good luck.
Re:Personal Lives clause in Separation Agreement? nova: Wow, that's interesting. I guess I should hire the private investigator prior to signing the document ;)
Yes, we should have a meet and greet party - it would be nice to meet people going through the same thing!
Good luck and keep us posted.
Re:Personal Lives clause in Separation Agreement? diskogirl: I have a sep. agreement in VA and it says the same thing.
Re:Personal Lives clause in Separation Agreement? Bryan in VA: As my handle indicates, i am in VA to.
I just had my lawyer draft up my seperation agreement & it is signed, sealed & now official.
This is a standard clause in VA. I talked to my lawyer about hiring a private investigator. He said"In Va Adultery is hard to prove". You must have pictures in the "act". Pictures in a restaurant or coming out of a motel are not evidence. Emails are also not evidence. He said that if you had positive proof, "pictures in the act", it would not normally play a role in the separation/divorce. My lawyer said that it would only play a minor role in alimony support. He said 10 years ago it was a big deal to the courts, but now the courts don't really care about it. Kinda sad!!
Hey, We Virginians should get together sometime.
I live close to Charlottesville.
Re:Personal Lives clause in Separation Agreement? wdotzler: I'm in VA too, but my papers don't say that, they do state that "neither party shall harass, molest or interfere with the other or attempt to compel the other to cohabitate with him or her", hmmmm, must be my lawyer :-\
Could it be because the divorce is being filed based on abandonment?
