I know my state and many others, it does not matter who files. Like was said before, usually the one that files ends up paying more up front (filing fees). Spousal support, child support etc, will likely not take into who files. These are based on need and income of the parties. Attourney fees are paid by the respective parties if they both have different attournies...So that wont matter.
I say, if you know its over...Go ahead and get a lawyer to help you file and assist you during the next few months. It will likely get hairy. You will have to pay the filing fees.
That all said, if you file first, the courts will serve her, not you. She can have her lawyer accept the papers so the sherrif does not come to her work and serve her there. If she files and you dont have your lawyer talk to hers, the sherrif will come and serve you at home or work. This can be kind of embarrassing and traumatic.
