Given she never even filed the papers with the court, I suspect that the committment in her heart was never really there.  If that is the case, then the marriage committment was never truly there.

Therefore, if  you feel it's time to have some fun, then by all means, GO!  Waiting for the judge to slam the gavel is formality, not reality.
