If it's only a mortgage issue on a purchase, you can talk to your mortgage broker about getting funded through your own "living trust". A lot of the good ones can set it up for you as well. That's what mine is doing. PM if you want to talk to my guy about it, I can talk to him about your situation. He's great and I've done the original purchase, and two refi's with him. I actually count him as a friend at this point...most of them you have to keep away from as you feel dirty after talking with them!

my lender is working hard on moving my loan thru without the final divorce decree. He's having my ex sign over a "gift" to me of the money I'm getting that I will use for my downpayment. And our lawyers are working on signing some other forms that will basically say that he will have no access to any of my accounts or my money, and that I owe him nothing, etc, etc. So hopefully this stuff will take place of having our official decree, just so that my loan goes thru. All the lenders care about is where my money came from, and do I really have it, I'm told.
We'll see what happens.
