Fire that lawyer immediately!!!! That was about the worst advice he could have given you guys... All of it!! He actually put your fiancée in a worse position and now you will have to dig yourselves out of a hole rather than let the mom do that. You see, by consenting to an agreement of shared custody you have made it very difficult to convince the courts that she is an unfit mother because any reasonable judge is naturally going to ask "If she is so unfit why did you agree to allow the child to stay with her". Now, in the courts opinion your fiancée is just about as unfit as she is. 

BTW, get yourself a female lawyer for this type of situation

He wishes he would have never agreed, he also thought she changed and was getting her life and priorities together, which now we know never happened. She has told us since may of '06 that she was working at this call center, well we called and did an employeement verification and she only worked there for a few weeks and went right back to stripping, she also had another baby since the beginning of all this and she is only 20, with a 7 month old and four year old. It's one of the most stressful things i've been through yet.

you may be able to sue the first lawyer for malpractice

Re: My fiancee's child custody case...... octoberbaby: I believe she is wanting child support to and also she has a major issue with me and me not being his mother, which I don't act like I'm his BIRTH mother. She also has a major control issue, if she loses control she will go crazy. It's really a bad situation. Also how could we sue him for malpractice? That would be interesting.
