How do you know this? Once again, in 15 years of dealing with divorce decrees EVERYDAY, I've NEVER ONCE seen someone thrown in jail for violating one.

I'm curious, how do you deal with divorce degrees everyday?

thing is, TD, how did you get in front of the judge? And did he have the scratch to pay that same day?

I filed contempt charges on him b/c he had done this so many times to me and he wasn't taking me seriously... he was found in contempt that day and was ordered to pay all outstanding debts or go to jail... honestly... I was hoping he would not pay and have to deal with going to jail so that he could run into Bubba there... He still has not learned his lesson... as of today he is now past the 30+ day mark again and I am trying to decide what my next step should be.. if I file again.. he will definately wind up in jail. I can not have it taken directly from his paychecks b/c whatever it is that he is doing for a living there is no record of it.

That's what he TOLD you that happened, but what actually happened?

Actually, I SAW what happened. It was just over a week after I started this job. We started the same day, from the same IT company, and we've worked together in another job for 2+ years. I have a pretty good history with him. Don't tell me that I don't know what I'm talking about.
Yes, it was over $1200 from the decree. 38 days in jail for it, which is the minimum sentence, plus the extra 8 days it took him to find the money.
If you've been doing this for 15 years and never seen anything like it, you've seriously got to do more work...

The next step is that you have his ass thrown in jail. Then he may finally stop fucking around with your head like he has been doing for the past 2 years.
Re: Looking at a decree violation wondering if anyone has answers... crushedman: I'm in the collections business. Here is a typical example that I see everyday:
Wife divorces husband. Husband owes credit card of 10k, in husband's name but not wife's name. In divorce decree, wife is required to pay the 10k. So husband forgets about it, doesn't make the minimum payments, and the credit card goes into default. Now we call the husband and ask him for the 10k. He tells us wife owes it, it's court ordered in the divorce decree. We tell him that (and this is true by the way) that the divorce decree doesn't cancel the original contract between him and the credit card company. In essense, husband owes credit card company and wife owes husband, but wife doesn't owe credit card company. If the wife has any money, we or the husband will try to execute on the judgement/decree and get her to pay. This is VERY difficult, with many hoops to jump through, even if she has the dough.
I could give a million examples with a million variations, but trust me, I've seen it all. Most authorities don't want to get in the middle of a divorce decree... even with a capias warrant. Most judges don't want to deal with it, attorney's don't like to deal with, NO ONE wants to deal with it. Even if these necessary parties are found to deal with the situation, it's still difficult and time consuming under the BEST of situations.
