COBRA Insurance? Drizzage: I am on my wife's ins. policy through her employer.  We are planning on finalizing our divorce early next year.  I want to continue my coverage through COBRA, but she has to change her insurance options at the start of the new year, and is going to drop me from her policy then.  The divorce will not be final by that time.  Do I need to be actively on the police at the time of the divorce to be eligible for COBRA?
Re: COBRA Insurance? barelybreathing: Yup........but confirm with your insurance carrier as well as your attorney and state laws re: health insurance.....

Insurance companies have downscoped coverage so much that you really need to check into this before anything is finalized......otherwise, you may not be eligible for COBRA.  

Oh and if you have temporary orders requiring her to continue to cover you thatn she cannot drop you until after the decree is finalized.......

Legally, at least in Texas, one cannot drop the other off the insurance until the date the divorce is legally final.  

My ex was out of my house and life back in March, but I had to keep her on my insurance till Sept when I went to court and finalized it.

Ellie: On that same note...My company doesn't offer dental benefits, so I am (was?) covered on my husband's insurance.  The divorce began in July; however, his company changed dental plans in June--found this out when I called the number on my "old" dental card.  Since our marriage began to crumble in mid-June, I have no idea if he ever renewed me on his policy or who the new company is for that matter (On his financial statement, he claims he is paying the dental premium).  Among other things, my husband doesn't respond to any attempts at communication, so calling and asking him if I'm on his policy will be fruitless.  What other recourse do I have to see if I still have dental coverage since I don't know who the new provider is?  Second question...Do I need a court order for him to retain me on his dental policy until the divorce is finalized?  FINAL QUESTION (promise) Is there a COBRA website where I can go to get more information on how to sign up once the divorce is final?

Re: COBRA Insurance? Bob-Bob: once your wife feels out the paper work to have you removed due to divorce COBRA will contact you with the information and pricing to continue your coverage. The thing to keep in mind is that this is controlled by federal law and not state law.

They are required to allow you to keep the coverage yourself for a period of 36 months.

another thing to keep in mind is that the first time you are late with a payment they will cancel you... no questions asked.
